Role Purpose

Reporting to Director-Standards and Compliance, the successful candidate will be responsible for planning, organising and managing the implementation of the investigations strategy, policies and plans according to defined standards, regulations and the approved teacher Code of Ethics and Conduct.

The main duties include but are not limited to:

  • Oversee and coordinate the daily work of the section.

  • Coordinate the teams charged with investigating reported cases of ethical breach and review case file reports and provide feedback and support on each investigation as need.

  • Develop and maintain investigation plans, policies, and procedures in accordance with legal provisions and best practice standards.

  • Establish departmental unit processes, systems, and guidelines to efficient and effective investigation services in alignment with the Council mandate and public interest.

  • Draw up plans in consultation with Human Capital and Corporate Affairs to inform, educate and build awareness on issues of teacher ethical conduct and established policies and processes to protect the public from breaches of conduct.

  • Contribute to the development and periodic Ethical Code of conduct.

  • In close liaison with Strategy, Planning and Research and Teacher Professional Services work to develop a comprehensive Ethical Code of Conduct.

  • Act as key liaison and subject matter advisor to the Council on issues of ethical breach and investigations.

  • Establish ongoing relationships and referral protocols with the necessary authorities such as police, DIS and DCEC.

  • In liaison with the Manager, Ethical Standards and Compliance, establish an ethics hotline to facilitate the reporting of conduct breaches by the public including monitoring procedures and actions to be taken following reporting.

  • Establish procedures to facilitate the safe reporting of potential issues of standards and code of conduct breaches including an ethical hotline for the public.

  • Ensure Departmental unit staff are trained on identifying and logging reported cases of misconduct and detailed steps and actions to take following logging of such grievances.

  • Establish communication protocols in respect of grievances including standards of confidentiality for the accused and the aggrieved as well as external stakeholder involvement such as the police and department of immigration.

  • Facilitate the logging of all reported cases of misconduct, their prioritisation and ongoing action and monitoring of such cases up to case closure.

  • Establish referral procedures in relation to reported cases either internally or externally.

  • Review cases identified for investigation and authorise the necessary investigations in accordance with agreed procedures for each case.

  • Obtain and review ongoing reports on active cases and provide guidance and support to the investigation teams.

  • Review case files of recommended cases for escalation to the disciplinary committees following investigation and provide inputs, advice, and authorisation.

  • Review case files of cases recommended for closure or handover to external authorities and provide inputs, advice, and authorisation.

  • Solicit advise and recommendations from the legal function on issues of investigation and any identified risks.

  • Review draft reports on investigation case portfolio and make contributions for information and decision making.

  • Report to the Director or other senior management on the progress and activities of the investigation unit.

  • Monitor case portfolio performance against set standards and guide and support the teams towards efficient and effective case completion and closure.

  • Attend and represent the function in Disciplinary Committee and Appeals committee hearings if required to do so.

  • Ensure quality submission of case files to the Disciplinary and Appeals Committee.

  • Ensure actions emanating for the unit from the Disciplinary and Appeals Committee are timeously addressed.

  • Facilitate the establishment of investigation file preparation, recording, filing, security and accessibility.

  • Review and authorise requests for access to case files or investigation documents internally and by external stakeholders.

  • Authorise departmental expenditure in accordance with financial policies and budgets.

  • Lead the departmental recruitment, selection, performance management, learning and development, employee relations, talent development, staff welfare and succession planning.

  • Ensure that the team carries out their assignments freely, unbiased, objectively, and professionally, and that they adhere to relevant legal and regulatory guidelines and in-house and standards policies in the conduct of their duties.

Qualifications and Experience

  • Degree in Law, Ethical Leadership or Applied Ethics or related fields along with management or leadership training .

  • A minimum of eight (8) years in law, audit, compliance, inspection regulation or investigative role. At least three (3) of these years should have been spent in a Supervisory / Management role of a large public or private organisation with experience implementing related policies and procedures.
