LEGAL SERVICES OFFICER (X2)- GABORONE- SIX (6) MONTHS FIXED TERM CONTRACT
In its pursuit to become a Competitive Commercial Power Utility within the Region, Botswana Power Corporation invites applications from suitably qualified, highly energetic, dynamic, result oriented, innovative, and customer focused individuals, who believe they can be part of a great team that delivers power to Botswana to apply for the below listed position not later than 04 October 2023.
Main purpose of the position
To provide legal and secretarial services to the Corporation by drafting legal documents and representing the Corporation in legal disputes to facilitate compliance with legal instruments and protect the Corporation’s interests.
Job Responsibilities
- Plans, organizes and prepares complex documents by using multiple computer applications (such as Microsoft Office), while also gathering and summarizing data for special reports.
- Supports, develops and prepares board papers, periodic progress reports, monthly litigation report and annual reports on legal issues.
- Accurately records, keeps board minutes and board resolutions including communicating decisions of the Board, Board-Sub Committees and the Management Executive Committee to the relevant offices including effective filing and management of access control to the official EXCO documents.
- Provides adequate and efficient secretariat support services for the Board, Board-Sub Committees and the Management Executive Committee, this includes preparation of meeting agendas, meeting invitations, facilitation of meeting documents and minutes.
- Leads the drafting and compiling of litigation actions in respect of all departments of the Corporation.
- Supports and develops contractual agreements for all departments of the Corporation.
- Identifies and manages shortcomings in current compliance processes, systems and procedures; develops ad hoc solutions to immediate problems within assigned unit and/or discipline.
- Works collectively with relevant departments of the Corporation to draft, develop and support policies as solutions to compliance shortcomings.
- Manage the general meeting logistics and liaise closely with the General Corporate Counsel on requirements for the Board, Board-Sub Committees and the Management Executive Committee.
- Leads the compilation, interpretation and delivery of clear and accurate prescribed research outcomes and supports others by carrying out designated research activities using existing systems and protocols.
- Executes a communications plan by working within established internal communication systems and procedures.
- Takes responsibility for managing and delivering a designated legal case work program in order to achieve prescribed outcomes.
- To provide accurate and timeous legal services and advice to the business in as follows;
- Researches and drafts legal opinions and legal advice on various legal issues to all departments of the Corporation and provide sound business alternative solutions in line with the legal provisions.
- Drafts, interprets and vets contractual agreements of all departments of the Corporation excluding the Generation department, including negotiating terms of contracts in favour of the Corporation.
- Leads and supports the institution of litigation matters at Courts and defending of suits for the Corporation including negotiating amicable settlements.
- Appears at any Courts in Botswana in favour of the Corporation in respect of litigation suits litigated internally.
- Facilitates and supports external attorneys in instituting and defending legal suits in favour of the Corporation by leading the compilation of relevant documents and vetting all documents prepared for the Corporation before submission at the Court Registry.
- Supervises external attorney on all outsourced matters and supports an effective working relationship between the Corporation and the external attorneys on the Corporation’s panel.
- Facilitates the overall enforcement of legal provisions to ensure compliance by the Corporation.
- Delivers prescribed outcomes by working within established procedures.
- Advises managers how to apply a wide variety of existing procedures and precedents.
Qualifications
- A minimum of Bachelor of Laws (LLB) from a recognised university.
- Admission to practice in the courts of Botswana
Experience
- At least minimum of four (4) years as a practising Attorney.
- Vast/ Extensive Experience in Civil Litigation and Commercial Law Practice
